Colorado is an all-mail ballot state (aka absentee ballot).  Every active registered elector will be mailed a ballot.  Ballots for the November 6th General Election will be mailed on October 15th – 19th.

Households can expect to receive TABOR notices booklets after October 5th.

Saguache County Voters:  Postmarks don’t count in Colorado!  If you are returning your ballot by mail, use 2 stamps and mail before October 29th, so your county clerk RECEIVES them by November 6th. 

After October 29th, bring them to our VSPC (Voter Service and Polling Center) in the Courthouse, or take them to our county outside ballot drop-off location (not a Post Office), which will be open 24/7 from October 22nd until 7:00 p.m. on Election Day, November 6th.

The 24-hour outside ballot drop box is located in the south parking lot at the Courthouse (501 4th St) in Saguache.

Voter Registration

Eligibility Requirements:

            *At least 16 years old, though they cannot vote until they are 18

            *Citizen of the United States

            *Resident of Colorado for 22 days before the election

There are several ways a person can register to vote.

  • In person at the county clerk’s office
  • By mail (including fax and email)
  • At a Driver’s License Office
  • At a voter registration agency (Human Services office, WIC office, disability office, etc.)
  • In person at a Voter Service and Polling Center (VSPC) up through election day
  • Through a Voter Registration Drive (VRD)
  • At a high school
  • Online at GoVoteColorado.com to register to vote and/or update your voter registration

  Colorado clerks, election and cybersecurity leaders to participate in training event Sept. 6 

National leaders in elections and cybersecurity are coming to Colorado to attend a training exercise hosted by Secretary of State Wayne Williams.

Think of it as war games, election style.

Nearly 200 county election officials, along with representatives from the U.S. Department of Homeland Security, the U.S. Election Assistance Commission and the National Association of Secretaries of State will participate in the event.

“Colorado is viewed as a leader in election security, and this exercise is just the latest event to make sure we are ready for the Nov. 6 general election,” Secretary Williams said. “There’s a reason The Washington Post wrote about how Colorado became the safest state to cast a vote.”

The event -- Election Preparedness for Infrastructure and Cybersecurity or EPIC -- will feature two, hour-long exercises. The first follows the five months leading to the 2018 general election. The second concerns Election Day. Each exercise will feature cyber and physical security scenarios and subsequent cybersecurity preparedness activities.

EPIC will be held at the Inverness Hotel, 200 Inverness Drive, in Englewood. Homeland Security will make a special presentation during the lunch.  Participants must be credentialed to attend the Thursday, September 6th  event. 

Among those who will attend EPIC is Leslie Reynolds, the executive director of the National Association of Secretaries of State, New Jersey Secretary of State Tahesha Way and New Mexico Secretary of State Maggie Toulouse Oliver.

"I am excited to participate in Secretary William’s election security tabletop exercise next week," Reynolds said. "These hands-on exercises are tremendously valuable. By bringing together state and local election officials to walk through possible threats or incidents and discuss and address appropriate responses, everyone walks away more prepared than when they arrived."

CBI-Approved Electronic Fingerprinting (CABS) Program

The Colorado Bureau of Investigation Biometric Identification and Records Unit is responsible for processing all legislated fingerprint-based criminal history background checks for employment and licensing purposes.  During Fiscal Year 2017, approximately 200,000 individuals were fingerprinted in the state of Colorado for non-criminal purposes and this number increases annually as legislation continues to mandate background checks for professions and positions of trust.  Senate Bill 17-189 was approved on April 24, 2017 which allows “any third party approved by the Colorado Bureau of Investigation (CBI) to take an applicant’s fingerprints for the purpose of obtaining a fingerprint-based criminal history record check.”

The CBI is currently in the process of implementing the Colorado Applicant Background Services (CABS) program in response to Senate Bill 17-189.  It is anticipated that the program will be fully implemented by fall of this year.  The CBI recently awarded two contracts allowing third party vendors to print and submit non-criminal applicant fingerprints for the State.  These vendor services will be located throughout the State, increasing applicants’ ability to obtain fingerprints in a timely manner. These services will also reduce the burden on Law Enforcement agencies as the vendors will electronically transmit the civil fingerprints.  The processing time and rejections will decrease tremendously. 

Numerous states have already gone to this type of statewide vendor-managed fingerprinting program with great success.  The CABS program will be supervised by the CBI, abiding by all National and State security guidelines.  Once the CABS program is in place and fully functioning all agencies working closely with civilian applicants who must provide fingerprints for background checks will direct those applicants to the CABS program, rather than to their local Law Enforcement agency, for fingerprinting services. 

Saguache County has already established a Colorado Non-Criminal Justice (CONCJ) account with the CBI.  Each CONCJ account will be included within the CABS program database matrix of accounts that will be imported into the vendor’s secure enrollment website.  Applicants will first be directed to the vendor’s enrollment website to enroll and schedule an appointment with that vendor.  Information specific to each agency and its applicants, as well as the specific CABS program processes will be forthcoming and will be communicated directly to each agency contact that is currently on file with the CBI Biometric Identification and Records Unit.

The estimated roll-out date for the CABS program is September 24, 2018.  The CBI anticipates incorporating a grace period to allow for an efficient transition from the current process to the CABS program process. 

Beginning July 1, 2021, the State will not accept non-Law Enforcement and non-CABS submissions. 

This program will only change the venue in which fingerprints are currently processed and transmitted to the CBI.  The CABS program will not impact the way the results of the background checks are currently administered.  All background check results will continue to be provided to the respective agency accounts via the CBI’s Secure Document Delivery System (SDDS) as they do today.

What does this have to do with the Clerk’s Office?  Candidates running for County Sheriff and County Coroner are required to take fingerprints for the purpose of obtaining a fingerprint-based criminal history record check.

This is also the case for new Liquor License Applicants.

September 22nd is UOCAVA Saturday

Election officials around the country will be sending ballots out to UOCAVA voters – no later than 45 days before the election.   

Counties are required to send ballots to military and overseas voters in a timely manner, as it is critical to their ability to successfully return it in time to be counted.  As you may know, many of these voters are located in remote and far regions of the world, and their recommended mailing dates for returning voted ballots to ensure delivery by election may vary.

UOCAVA is the Uniformed Overseas Citizen Absentee Voting Act.  This law was passed by Congress to make voting for military and overseas citizens easier.   This Act provides the minimum legal requirements for voting for these citizens.

UOCAVA citizens are U.S. citizens who are active members of the Uniformed Services, the Merchant Marine, their family members, and U.S. citizens residing outside the United States.

Colorado refers to all UOCAVA voters as “Covered Voters” and it treats all UOCAVA voters the same.

The Federal Voting Assistance Program (FVAP) is a federal agency that is charged with assisting military and overseas voters and their families with the registration and voting process.  The FVAP website is a great resource for military and overseas voters to find information.

The Overseas Vote Foundation website also offers online services to overseas and military voters.

Many UOCAVA voters move often and need to update their addresses.  It is our practice to communicate with all UOCAVA voters once a year to make sure we have current information.

Many UOCAVA electors will request their ballots by email, fax or online delivery because they know that they will not receive a mail ballot at their overseas address.

How long did it take an 11-year-old to hack the Florida Secretary of State’s Web page for reporting election results?

Answer: 10 minutes.

According to GOVTECH TODAY, it was only a replica of the actual website, but that doesn’t negate the seriousness of the ease of the break-in. Emmett, an 11-year-old Austin, Texas, resident, participated in an election security hacking demonstration at Def Con in Las Vegas. The event pitted kids against replicas of different secretary of states’ Web pages for reporting election results to the public, complete with all the security features (or lack thereof) that the real-life Web pages have.

Overall, 47 kids took a swing at hacking the replica pages. TechCrunch reports that 89 percent of them successfully broke in and were able to alter the information displayed.

“The really important reason why we’re doing this is because we’re not taking the problem serious enough how significantly someone can mess with our elections,” said Nico Sell, founder of Wickr, which helped create the pseudo Web pages. “And by showing this with eight-year-old kids we can call attention to the problem in such a way that we can fix the system so our democracy isn’t ruined.”

The Clerk’s office works hard to protect the integrity of the election process.  In doing so, we have taken extra steps to safeguard Saguache County’s elections by becoming a member of EI-ISAC.   Membership is open to election-focused government entities.

There is no cost to join the EI-ISAC. It serves as the central cybersecurity resource for the nation’s election-focused government entities.

The Elections Infrastructure Information Sharing and Analysis Center (EI-ISAC) was established to support the cybersecurity needs of the elections subsector. Through the EI-ISAC, election agencies will gain access to an elections-focused cyber defense suite, including sector-specific threat intelligence products, incident response and remediation, threat and vulnerability monitoring, cybersecurity awareness and training products, and tools for implementing security best practices.

The Computer Emergency Response Team (CERT) is comprised of highly trained staff who can provide malware analysis, reverse engineering, log analysis, forensics analysis and security assessments. Incident response services and cyber threat intelligence are available to Saguache County.

As a member, we have direct access to cybersecurity advisories and alerts, vulnerability assessments and incident response for entities experiencing a cyber threat, secure information sharing through the Homeland Security Information Network (HSIN) portal, tabletop exercises, a weekly malicious domains/IP report, multiple DHS initiatives, CIS SecureSuite® Membership, and more.

County Initiatives

Electors of counties do not have constitutional rights of initiative, unlike state and municipal electors who have the right to adopt state and municipal legislation by initiative and referendum.

Although the text of TABOR contains nearly 2,000 words and addressed “multiple subjects”, its proponents convinced a majority of Colorado voters to approve it in 1992 with a campaign essentially based on one simple message: “VOTE ON TAXES!”

The advocates and supporters of TABOR promised above all that this constitutional amendment would inhibit the relentless “growth of government” by forevermore requiring the consent of the voters before any new tax could be adopted or before any existing tax could be increased.

The irony of this pitch, and one that was not lost on the courts, is that TABOR did not give rise to any new substantive voting rights as some of its supporters had suggested.  The people of Colorado had long since reserved to themselves the powers of initiative and referendum, thus allowing for the direct control of taxation and other legislative matters at the ballot box.

Moreover, several preexisting state and local laws and charter provisions already required municipal voters to approve tax increases.  For example, laws governing statutory municipalities (as well as many counterpart home rule charter provisions) already required voter approval for new or increased sales taxes.  Likewise, voter approval was already required for tax increases to service general obligation debt.

Thus, the mandate to “VOTE ON TAXES” was hardly revolutionary to Colorado.

In contrast, far and away the single most radical change wrought by TABOR was its formulaic limitation on the annual growth of revenues.  It does not limit the amount of money that may be budgeted.  It does not limit the amount of money that may be appropriated.  It does not limit the amount of money that maybe “spent” in any conventional sense of the word.

Instead, it limits the amount of revenue that may be retained in any particular year from most sources. (including both taxes and fees) according to a rigid one-size-fits-all revenue cap, and requires a refund of “excess” revenue received in any particular year absent voter approval to keep the excess.  This is perhaps the most important thing for every official to understand about the way TABOR works.

The bottom line is citizens have the constitutional right to initiate municipal and state legislation.  With one exception, they have no such right to initiate county legislative matters.  That’s because that legislative power is vested in the General Assembly and was not reserved by the people in our constitution.

New Election Rules are necessary to provide clear guidance to the public and county clerks concerning acceptable identification, voter registration at county jails, and ballot transmission to county jails and detention facilities.

Statement of Basis, Purpose, and Specific Statutory Authority

Office of the Secretary of State Election Rules 8 CCR 1505-1

I. Basis and Purpose: This statement explains amendments to the Colorado Secretary of State Election Rules. The amendments are intended to ensure uniform and proper administration, implementation, and enforcement of Federal and Colorado election laws, improve elections administration in Colorado, and increase the transparency and security of the election process.

II. Amendments to Rule 2.3.2(a) clarify acceptable government documents for identification. Specifically, new subsection (4) provides that a government document includes written correspondence from the county sheriff or his or her designee to the county clerk indicating that the elector is confined in a county jail or detention facility.

III. New Rule 2.19 establishes rules concerning registration of electors who are confined in a county jail or detention facility.

IV. New Rule 7.17 establishes requirements concerning ballot transmission to county jails and detention facilities.

                     Amendments to Rule 2.3. 2 concerning acceptable identification:

2.3.2 As used in section 1-1-1 04(19.5), C.R.S., government document means a document issued by a city, county, state, or federal government.

Motor Vehicle Power of Attorney

The State of Colorado provides two specific/limited power of attorney forms for use in motor vehicle transactions.

DR 2175 Non-Secure Power of Attorney

This is the most commonly used form.

The purpose of this Power of Attorney is to give the person you designate (your agent) powers to handle your property and affairs, which may include power to pledge, sell, or otherwise dispose of the motor vehicle described, without any advance notice to you.  This form does not impose a duty on your agent to exercise granted powers, but your agent must use due care to act on your benefit and in accordance with the provisions of this form and must keep a record of receipts, disbursements, and significant actions taken as agent.

This form is used wen the attorney in fact will be signing for EITHER the buyer OR seller.  This form does not include the odometer disclosure.  When using this form, the odometer disclosure is completed on the title document to comply with Federal Odometer Regulations.  The Non-Secure Power of Attorney can also be used by an individual when the appointed person is acting as the buyer and the seller and the odometer does not fall within Federal Odometer Regulations.

Secure and Verifiable Identification requirements are the same for all power of attorney forms; Secure, Non-Secure, Military or General.

The Secure and Verifiable Identification of the grantor (the person granting the Power of Attorney) is required to be recorded either on the Power of Attorney or the DR2842 Supplemental Identification Form and the agent (the person granted power of attorney) will be required to present Secure and Verifiable Identification when the agent has been appointed the power to:

  • Apply for and take receipt of an original certificate of title on behalf of the Grantor
  • Apply for and take receipt of a new registration on behalf of the Grantor
  • Apply for and take receipt of a new temporary registration on behalf of the Grantor
  • Apply for and take receipt of a duplicate title with an issue date on or after July 1, 2006 on behalf of the Grantor

The Secure and Verifiable Identification is not required for the grantor or for their agent when the agent has been appointed the power to:

  • Record or Release a lien
  • To transfer ownership and acknowledge odometer reading

We Crushed It!

Our audit and canvass for the 2018 Saguache County Primary Election was held on July 9th.

After all ballots are tabulated, the Secretary of State’s Office defines the audit.  Ballots are then randomly selected.  We had 122 ballots to audit out of the 1397 ballots that were counted.   All contests on each of the 122 ballots had to be audited.

With the Dominion Voting System, audits are no longer done by a hand count, but rather on a computer which is monitored by the state.

Six election judges and one staff member spent approximately 3 hours completing the audit process.  They were required to report all under votes, over votes, blank votes and when to use “no consensus”.   (Compare that to the 20 election judges and two days it took to accomplish audit results in the 2016 General Election!  The new Dominion Voting System makes the difference.)

Shortly after completing the audit we received a personal text from the Secretary of State’s Office, “This is Dwight.  You crushed it – zero discrepancies!”

We passed round one on the first go.  We were done!  Sometimes counties are required to go to round two and audit additional ballots.

Prior to the audit, we also received a phone call from the Secretary of State’s Office asking if we thought they needed to make a visit to our county before Election Day.  Our reply was, “no”.  They replied, “We’re just checking.  We took you off our “dumpster list”.  We’re needed in other counties”.

Once again, I applaud our election judges and staff for their incredible teamwork!

July 18th is the last day for counties to complete the canvass and submit the official abstract of votes cast for the Primary Election to the Secretary of State.  July 19th is the deadline for counties to upload the final canvass results to the ENR (Election Night Reporting) system.  Official results will then be posted.

US Imaging is scheduled to begin the digitizing process of our old books on July 13th.  County records are irreplaceable and extremely valuable; therefore, they will scan all media on-site. 

This is a 3 stage, 6 phase project.  This first stage of Phase 1 will take approximately 3 days (Friday thru Sunday).

US Imaging will provide Saguache County with an unparalleled combination of county expertise, proven processes and state of the art technology to provide the highest quality images and indexes possible.  US Imaging understands the scope of work required, the critical success factors, and the County’s goals.  They have become America’s premier County Conversion Service.

They have been in the imaging business for 42 years and have successfully served over 667 Counties nationwide.  They are the only scanning vendor in America that exclusively serves Counties.



  • State of the Art Scanners – US Imaging is a beta test site for multiple scanner manufacturers and receive new technology several months before competitors. They are constantly upgrading and currently operate the very latest scanners for Bound books, Rollfilm, Cards, Aperture Cards and Drawings.
  • ImageXpress – A software utility that allows Counties to easily access images by book-page #, document #, quickly scroll through an entire book, roll, jacket or aperture card, view both TIFF & JPEG images, adjust JPEG grayscale contrast, crop, deskew, redact, mask, print, save or e-mail images as needed.



  • 100% of the images are inspected for legibility, grouped together as documents and indexed by 2 separate operators and compared electronically, any mismatches are inspected by a third operator and corrected for 100% accuracy.
  • Poor quality reporting – 100% of the images are inspected two times as 12” x 16” images on 20” portrait monitors for legibility. We will provide a detailed report of Book-Page # or Document-Page # and the reason that it has been reported as poor quality: too light, too dark, blurry, A Page, retake, missing, etc.
  • Image review – A software utility that sorts and filters the images on the poor-quality image report and displays the poor-quality images. The County can easily uncheck images that are acceptable quality.



US Imaging can adjust the poor contrast of an entire roll, splice, book, jacket, aperture card, document, page or any specific area on a page to provide the most legible images possible.

Approximately $168,000 of the grant money will be used to fund our digitizing project.

Postmarks Don’t Count in Colorado

Saguache County Voters:  Postmarks don’t count in Colorado!  If you are returning your ballot by mail, use 2 stamps and mail before June 18th, so your county clerk RECEIVES them by June 26th. 

After June 18th, take them to our county outside ballot drop-off location (not a USPS mailbox), which will be open from June 22nd until 7:00 p.m. on Election Day, June 26th.

The 24-hour ballot drop box is located in the south parking lot at the courthouse (501 4th St) in Saguache.

Colorado Secretary of State Wayne Williams announced that as of June 12, 2018, so far 134,038 voters have returned ballots for the June 26 primary election.

The data is broken down by gender, county and party and, for the first time ever, includes the number of unaffiliated voters who have turned in ballots.

So far, 55,584 Republican ballots (not affiliated Republican voters), 78,199 Democratic ballots and 25,502 envelopes from unaffiliated voters have turned in ballots.

Voters, in 2016, approved Proposition 108, which automatically allows unaffiliated voters to participate in primary elections without affiliating with a particular party. Williams in March launched the UChooseCO campaign to remind unaffiliated voters they will receive two ballots but they can only vote one. If they vote both the Republican and Democrat ballot neither one will count.

This is the first primary election where unaffiliated voters are allowed to automatically participate.  Unaffiliated voters who expressed a preference for a Republican or democrat ballot were sent that party’s ballot, but those who did not  were sent both ballots.  Again, only vote one.  If you vote both, neither ballot will count.

The turnout totals do not indicate whether an unaffiliated voter picked a Republican or Democratic ballot.

Also, the statistics show that either no ballots or a small number of ballots have been turned in for some smaller counties but that's because the ballots have yet to be processed. Their numbers also do not reflect ballots put in 24-hour drop boxes over the weekend, but those ballots will be reflected in Tuesday's report.

Here is turnout data for the last decade:

  • 2016       644,723 ballots cast / 3,015,250 active voters = 21.38% turnout
  • 2014       634,181 ballots cast / 2,903,612 active voters = 21.84% turnout
  • 2012       530,119 ballots cast / 2,231,484 active voters = 23.76% turnout
  • 2010       774,071 ballots cast / 2,391,825 active voters = 32.36% turnout
  • 2008       488,130 ballots cast / 2,223,503 active voters = 21.95% turnout

As local officials across the country scramble to hack-proof their voting systems ahead of the midterm elections, there’s one state that is paving the way as a leader in election security.

Colorado has done virtually everything election experts recommend states do to stave off a repeat of 2016, when Russian hackers targeted 21 states as part of the Russian government’s massive election interference campaign.

  • The state records every vote on a paper ballot.
  • It conducts rigorous post-election audits favored by voting researchers.
  • Nearly every county is equipped with up-to-date voting machines.
  • Election officials take part in security trainings and IT workers test computer networks for weaknesses.

Although there’s no evidence that votes were altered in 2016, the stakes are high.

The Senate Intelligence Committee, which is investigating Russia’s interference, released a report affirming that states should be the main entities running elections.  But lawmakers are still concerned about potential vulnerabilities in election infrastructure.

Although more than half of all states require post-election auditing, only Colorado, Rhode Island and New Mexico use risk-limiting audits.

“Colorado is certainly hitting all the high points that we’ve been arguing others should,” said Joseph Lorenzo Hall, chief technologist at the Center for Democracy and Technology and an expert on voting systems.  “It’s hard to compare states apples-to-apples because they’re so different, but Colorado has really been a leader.”

According to Williams, the state has been proactive in other ways, too.  Its county clerks, for example, use two-factor authentication to access voter registration databases, which Russian hackers targeted in 2016.  And in 2017 became the first state in the country to complete a statewide risk-limiting audit.

“In Colorado, even if something happens, I don’t have to worry about it because there’s a process in place,” said Marian Schneider, president of the nonprofit organization, Verified Voting.  “It’s almost like a disaster recovery plan for elections that if a disaster were to befall the vote count, we could recover from it.”

Ballots Go Out June 4, But Remember, Don't Spoil It

Ballots for the June 26 primary election will be mailed on June 4th as Coloradans choose their nominees in several key open races, including Governor, Attorney General and State Treasurer.

Voters also will select their nominees for Congress, the Colorado General Assembly and other races.  Counties also are holding elections for Sheriff, Commissioner, Clerk and Recorder, Coroner and Surveyor.

It's the first time in state history that unaffiliated voters will be able to participate in the primary without first choosing to be a member of a particular party.

Colorado Secretary of State Wayne Williams has been delivering a blunt message to those unaffiliated voters: Don't spoil it -- only vote one ballot.

That's because they will receive both the Democratic and Republican ballots unless they earlier selected which ballot they wanted mailed to their residence. If a person votes both the Republican and Democratic ballot, neither one will count.

Coloradans in 2016 approved Proposition 108, which allows automatic participation for unaffiliated voters. 

“The voters have spoken,” Williams said, “and it’s the job of election officials to implement their will as best we can."

County clerks faced a May 12 deadline to mail ballots for overseas and military voters.

Voter Registration Deadlines
  • People can register to vote and change their address up through Election Day, June 26th.
  • Last day for voters who are affiliated with a political party to change or withdraw their affiliation if they wish to vote in a different party’s primary election, May 29th.
  • Last day for unaffiliated voters to select a preference before the Primary, May 29th. If no preference is made by this date, you will receive two ballots.  Remember – ONLY VOTE ONE! – for your ballot to count.   
  • Voters who are registering for the first time and by mail, agency, and VRD must register 22 days before the election, June 4th.
  • If a person registers with a Voter Registration Drive (VRD), the application must be submitted 22 days before the election, June 4th.
  • An existing voter may register by mail or online up to 8 days before the election to receive a ballot in the mail, June 18th.
  • After the 8th day, a person must register in-person (County Clerk’s office, VSPC) and receive his/her ballot in person, June 19th – 26th.
  • UOCAVA (Uniformed Overseas Citizen Absentee Voter Act) are not subject to the 8-day deadline.

Know the Date

June 4, 2018 – First day mail ballots may be mailed to voters.

June 4, 2018 – Logic and Accuracy Test, 9:00 AM.  Public is welcome.

June 26, 2018 – Primary Election.  Polls are open from 7:00 AM – 7:00 PM on the main floor of the Saguache County Courthouse located at 501 4th St., Saguache.

24 hr. Ballot Drop Box Open – June 22nd – June 25th and up to 7:00 PM June 26th.

Colorado is an ALL mail ballot state.  It is no longer necessary for a voter to go in person to vote.  Every active registered elector will receive a ballot in the mail.

As of May 7, 2018, Colorado Secretary of State Wayne Williams gave this information to the press:

            “So far, 36,729 unaffiliated voters have picked which ballot to vote in the June 26 Primary.  They choose 20,419 D ballots or 55.9%; R’s: 13,919 or 37.9%.  There are no third-party primaries so U’s who picked those will receive both ballots.  ONLY RETURN ONE.”

(A cry of joy & satisfaction!)

As custodians of public records, the Saguache County Clerk and Recorder’s office respectfully requested funding assistance through a grant for digitizing our old books, aperture cards, microfiche and other documents - indexing of the documents, providing permanent archiving of our historical documents and for our web hosted public access site.

Saguache County is where the West was settled.  Our county is economically depressed with no significant tax base to generate revenue for badly needed services such as this project.  Our records go back to the 1800’s and some of our books are in very poor condition with an occasional page missing.  We are dedicated to preserving this important history, but without digitizing, our old books are at risk of further deterioration and even loss of important information.  Approval of this grant request for Saguache County will now link our past with the present and take us forward into the future of technology for historic preservation while providing state-of-the-art services to our citizens.

We also requested enough funds to add a slipsheet printer, and a Laser Jet Printer as well as a Public Search Workstation, to include maintenance and Internet services.  Some of our office equipment used for recording is outdated.  At present we have just one public search station.  We will also purchase a light table for viewing recorded plat maps.

Our Board of County Commissioners is very excited about this project and eager for us to get started.  They realize the seriousness and historic nature of these documents and would like to see them preserved in timeless quality.

A lot of time and careful consideration was given to this grant application.  Our entire staff was involved throughout the process.  Ben and Desiree kept the daily operations of the clerk’s office going while Jane made important contacts for letters of support from recording stakeholders such as the Abstract Office, title companies, searchers, etc.  – we even received a letter of support from the Saguache County Museum.  There were many demands on everyone’s time.

We deeply appreciate the Electronic Recording Technology Board’s approval of our full request of $181,553.89!

No strings attached.  The grant money we receive will be at no cost to the taxpayer.   No in-kind contributions and no payback of grant funds.  Eureka!

What is a Logic and Accuracy (L&A) Test? 
  • A step-by-step documented review of a voting device's ability, prior to use in any election, to accurately produce voter choice for the candidates and ballot measures in an election.
  • A test that ensures the election has been programmed correctly by casting votes for all offices and ballot questions and issues that are on the ballot on a representative sampling of voting equipment.
  • A test that ensures the voting system will accurately count all types of ballots (mail, provisional, VSPC, and audio ballots).
Why do we have an L&A Test?
The L&A test ensures that
  • The election is programmed correctly
  • The voting equipment is functioning properly, and
  • The voting equipment is counting ballots accurately.
The test is conducted in public so that the public knows their votes are being counted accurately.
Several members from the public participate in the L&A test, either as members of the Testing Board or as observers*. An important part of the election process is to be open and transparent when preparing for an election.
*Each major political party, minor political party, ballot issue committee that has an issue on the ballot, and the coordinating entity may designate one person who must be allowed to witness all public tests and the counting of pretest votes.
Preparing for the Test -The Testing Board
Before starting the L&A test process, the Designated Election Official (DEO) appoints a Testing Board.
The Testing Board must consist of one registered elector from each of the major political parties. The electors must be registered voters in the county.
Testing Board Members will be:
1 Democratic Party member
1 Republican Party member
Testing Board Ballots
The Testing Board will be given 25 ballots each in advance of the test.  Board members will vote their ballots and record the votes on the hand tally sheet.
County Test Ballots
The County will also have test ballots.  These test ballots must include:
  • At least one ballot from every style
  • Enough ballots to represent a vote for every position on each ballot style
  • At least one ballot that is fully marked (all overvotes)
  • At least one ballot that is blank (all undervotes)
The number of test ballots a county is required to use depends upon the number of candidates and the number of choices in the most complex race, and/or the number of precincts. 
Central Scanner Testing
Here are the steps for central scanner equipment testing.  Each group of ballots will be run individually through the equipment. We will then verify that the machine count matches the hand count.
If the totals do not match, we will re-check the hand tallies. Often, human error can account for the discrepancy.
Resealing the Equipment
All equipment is reset and resealed in the presence of the Testing Board.
A Legal Notice will be published with information, including the date and time for the 2018 Primary LAT.  The public is always welcome.

*Voters Affiliated with a Party That is not holding a Primary:
  • Voters who are affiliated with a major party (Republican or Democratic) will get the ballot for that party.
  • Voters who are affiliated with a minor party will get that party ballot if the minor party is holding a Primary.
  • A voter affiliated with a political party that is not participating in the Primary Election will not receive a mail ballot.
*Unaffiliated Voters May Choose a Party Preference:
  • Unaffiliated voters may choose a party preference. This means they can choose which party ballot they want.
  • An unaffiliated voter could preference for a Republican ballot, or an unaffiliated voter could preference for a Democratic ballot.
  • If a minor party is participating, an unaffiliated could preference a minor party if the minor party is allowing unaffiliated voters to participate.
  • Remember that a voter must choose a preference by May 29th.
  • The voter can indicate a preference by filling out a voter registration form.
*Unaffiliated Voters Who Don’t Choose a Party Preference:
  • Some unaffiliated voters will not affiliate and they won’t select a party preference.
  • In this case, an unaffiliated voter will get a “Ballot Packet.”
  • The ballot packet contains all applicable ballot styles, including the Republican or Democratic ballots. It could also include a non-partisan ballot if there are issues and/or questions on the ballot.  (Ballot Measures).
  • The voter must choose one party’s ballot to vote.
  • The voter should only return the party’s ballot that he/she voted.
*Voter Anonymity
Frequently Asked Question: “I am an unaffiliated voter and I received my ballot packet.  Will someone be able to find out how I voted?”
  • Which party ballot a voter voted is public information.
  • HOW a person voted is still private.
  • To maintain privacy for the unaffiliated voter, first, an election judge must remove the ballot, enclosed in its secrecy sleeve, from the mail ballot return envelope and pass it to a bipartisan team of judges without allowing the team of judges to determine the identity of the voter.
  • The bipartisan team of election judges must remove the ballot from its secrecy sleeve, review the ballot, and audibly report to the first election judge which political party’s election the voter voted in.
  • The first election judge must record in SCORE which political party’s election the voter voted in or document the proper party information for later recording in SCORE.
  • This process requires separate judges to make sure the voter’s privacy is maintained.
Unaffiliated voters are allowed to vote in the Primary Election for the first time EVER.  Just remember -  Jane, Desiree, Ben and I are here to help.

Voter Participation Center Mailing

From March 21-24, households across Colorado will be receiving voter registration mailings from the non-profit group Voter Participation Center (VPC).

These mailings will include voter registration forms and directions on how to fill out and return the form to their county clerk and recorder.  Currently, VPC intends to mail out about 120,000 letters to households across the state.  36 will be mailed to Saguache County.

Complete brand records shall be kept on file for inspection by the public at the office of each county clerk and recorder?
Upon the first of every month or as soon thereafter as possible, the state board of stock inspection commissioners shall cause to be exhibited in the office of the county clerk and recorder in all counties in the state and post, when permissible, in Colorado licensed livestock markets a list showing all the brands and transfers recorded for the previous calendar month.  Said list shall show a facsimile of the brand, the name of the owner, and the owner’s post-office address, county, and state.  The list shall remain posted until the following month when the new list is posted.
Brand inspection is mandatory on cattle, horses, mules and donkeys.
This has been part of Colorado’s history in one form or another since 1865.
The Colorado Brand Book is a periodic record of livestock brands registered with the Colorado state livestock agency.
Colorado Brand Book goes back at least as far as the early 1900’s.  No copyright renewals have been found for this publication.  It is currently issued at 5-year intervals, immediately following the assessment of brands.
In 1938 the Colorado Brand Book cost $2.  In 2018 the price of the Colorado Brand Book (2017 Edition) is $30.  The 2017 brand book includes all brands recorded and paid as of November 30, 2017.
The expected delivery of the 2017 Colorado Brand Book is sometime this month.

Let’s Make Sure Your Vote Counts.

Recent changes in Colorado law now allow unaffiliated voters to vote in a primary election.

Here’s how it works:

  1. You receive two ballots in your packet, one Democratic ballot and one Republican ballot.
  2. Choose ONLY ONE of these ballots and fill it out. Discard the ballot you won’t use.
  3. Return your ONE voted ballot in the return envelope.

Important things to remember:

  • Sending in two voted ballots will disqualify all of your votes.
  • Your vote in this election will not affiliate you with a political party.

The 2018 Saguache County Primary Election is June 26, 2018.

Election Judges

Election judges are registered electors appointed by the county clerk to perform the election duties assigned by the clerk.  Judges are appointed to serve two-year terms and ensure that elections are administered fairly according to federal and state law.

To be an election judge, an individual must:

  • Be a registered elector in the political subdivision (except for student election judges).
  • Be physically and mentally able to perform the assigned tasks.
  • Attend a training provided by the county clerk.
  • Not have been convicted of fraud or other election offense.
  • Not be a candidate or be related by blood, marriage, or civil union to the second degree to a candidate whose name appears on the ballot.

Election judges must have a background check and affirm to an oath.

The county clerk may assign an election judge based upon appropriate skill level and interest.

There must be at least three judges at each VSPC (Voter Service and Polling Center), one of whom may be a student judge.  As long as two judges of differing affiliations are present, voting may continue.  If, however, there are only two judges of the same affiliation or only one judge, voting may not proceed.

A county with fewer than 5,001 active electors by the 90th day before Election Day may use regular county staff that is sworn in as election judges to conduct signature verification.  This is a practice we use in Saguache County.

Although we experienced a big learning curve with the new Dominion Voting System, I think it was mutually agreed, their jobs as election judges just got easier.

Election judges are the backbone of the voting process.  They help to ensure transparency and elevate voter trust.  Saying “thanks” doesn’t seem enough for their dedication to protect the integrity of elections.

What is CORA?

“CORA” stands for “Colorado Open Records Act”.  In the spirit of open government, the Colorado Open Records Act requires that most public records be available to the public.  Anyone can request information that is in the possession of a government office.  24- 72 (C.R.S.)

Where do I submit my records request?

You must submit your request to the custodian of the record - the government office that actually holds the record itself.  There is no central repository for public records or single office that fulfills public records requests in Colorado.  If you don’t know how to contact a person from the appropriate office, call the government entity and ask how to submit your request.

Do all open records requests go through the Saguache County Clerk’s Office?

No.  An open records request needs to be filed directly with the appropriate government office or the custodian of the records that you want to see.  Other agencies may have different processes for open records requests, so contact the office ahead of time to review its process.

Do I have to submit a CORA request with the Saguache County Clerk’s Office to get information?

No.  It is the intent of our office to provide records to the public without requiring a CORA request.

Before making a CORA request, contact our office to request information from our staff.  Many documents are already available to the public.  We would be more than happy to help you access these filings without asking you to make a CORA request.

Inspire Colorado

An organization named Inspire Colorado has joined our efforts for nonpartisan voter registration through our schools.  Inspire Colorado Program Coordinators train and support juniors and seniors in high schools to conduct nonpartisan peer-to-peer voter registration drives in their schools with the goal of registering to vote 85% of eligible seniors.  Their goal is to amplify the youth voice by increasing voter turnout among young adults through nonpartisan voter registration, education and student engagement with elected officials.

Inspire Colorado provides civic experience for high school juniors and seniors; transforming young leaders’ inspiration into action that improves our communities and strengthens our democracy.

Inspire Colorado Experience:

  • Lead official voter registration efforts in high schools.
  • Engage peers in Get Out The Vote (GOTV).
  • Meet with lawmakers and community organizations tackling some of Colorado’s most pressing problems.
  • Plan with peers to earn the Eliza Pickrell Routt Award.

-Works with more than 30 Colorado High Schools.

Have you ever heard someone say, “That cost me two bucks!”?  How did dollars ever get the nickname “bucks”?

A male deer is called a buck.  Many pioneers hunted bucks.  They ate the deer meat and kept the deerskins.  Some deerskins were used to make clothes.  The rest of the deerskins were sold.  The hunters were given a dollar for each skin of a buck.  Many times the hunters had to trade their deerskins for a dollar’s or a buck’s worth of supplies.

Thus, pioneers started calling a dollar a “buck”.

So . . . the moral of the story - get INSPIRED now.  It won’t even cost you a “buck”!

County Issued Exempt Military Plates

As of February 1, 2018, we have been able to process what many refer to as “free” plates.  This is really a wonderful new service for our citizens.

Many Military-themed Plates offer a qualified individual a Fee-Exempt Registration for their first set of these plates, referred to as Exempt Military Plates.  Previously, these Exempt Military License Plates were issued only by the State.  Saguache County can now issue these plates.  The plates below no longer require an authorization from Title & Registration Section.  Each Plate Type is eligible for Persons with Disabilities plate versions.

  • Air Force Cross
  • Silver Star
  • Disabled Veteran
  • Distinguished Service Cross
  • Distinguished Service Flying Cross
  • Former Prisoner of War
  • Pearl Harbor Survivor
  • Medal of Honor
  • Navy Cross
  • Purple Heart
  • World War II Veteran

Requirements for an Exempt Military License Plate include:

  • Ownership documents or Title
  • Proof of current valid insurance
  • The First Plate per Applicant is waived all Ownership Taxes/License Fees
  • Submit a completed DR2002 Military License Plate Application
  • Second and subsequent issuance of Military Plates in which a new plate is issued will be assessed a one-time additional Special Plate Fee of $50.00, in addition to all License Fees and Ownership Tax

The Exempt  Military Plates must still meet the qualification requirements per C.R.S. 42-3-213(1)(b)(I)(A)(B)(C)(D)(E)(F)(I)

  • Exempt Military Plates cannot be Personalized
  • Exempt Military Plates can be issued to Passenger, Motorcycles, Farm Trucks, Motor Home and Light Trucks and Recreational Vehicles (that do not exceed 16,000 lbs. empty weight).
  • Disabled Veteran and Disabled Veteran Handicap Plates require an eligibility letter stating that the veteran meets one of the following:
    • Permanent service connected disability rated at 50% or more, or
    • Loss or permanent loss of use of one or both feet, or
    • Loss or permanent loss of one or both hands, or
    • Loss of sight in both eyes
    • Verification of the Qualification need to be in writing from the Veterans Administration, or the Branch of Service (on Official Military Stationary) from which the veteran’s compensation is received
    • Disabled Veteran Handicap applicant must submit a DR2219 Parking Privileges Application
    • Honorable Discharge from a branch of the Armed Services of the United States can be proved with a copy of the DD214 or other discharge documents issued by the Armed Services of the United States

Saguache County VOTES!
According to the Webster dictionary, a vote is a decision by one or more persons on a proposal, resolution, bill, etc., or a choice between candidates for office, expressed by written ballot, voice, show of hands, etc.
Voting is a PRIVILEGE.  Voting is your LEGAL RIGHT.  Voting is your RESPONSIBILITY.
In an effort to offer every eligible citizen of Saguache County the ability to vote, an invitation was sent to each school in our county inviting them to participate in the voter registration award program offered by the Secretary of State’s Office.
Background information for the voter registration award:
Eliza Pickrell Routt, with her husband, John Routt, settled in Colorado on the brink of its statehood in 1875.  John Routt would be elected the first Governor, making Eliza Pickrell Routt the first, First Lady of Colorado.  In this role, she dedicated herself to building a structured community with equal rights for women.  She joined the Non-Partisan Suffrage Association of Colorado and served as president of the City League of Denver branch.  In honor of her commitment to getting suffrage passed, Routt was the first woman registered to vote in Colorado.
In honor of Eliza Pickrell Routt’s dedication to voting equality, the Secretary of State’s office has created the Eliza Pickrell Routt Award.  This award is given to high schools that have 85% of eligible seniors registered to vote.

Eligibility Requirements:
            *At least 16 years old, though they cannot vote until they are 18
            *Citizen of the United States
            *Resident of Colorado for 22 days before the election
There are several ways a person can register to vote.
  • In person at the county clerk’s office
  • By mail (including fax and email)
  • At a Driver’s License Office
  • At a voter registration agency (Human Services office, WIC office, disability office, etc.)
  • In person at a Voter Service and Polling Center (VSPC) up through election day
  • Through a Voter Registration Drive (VRD)
  • At a high school
  • Online at GoVoteColorado.com to register to vote and/or update your voter registration
  • Other offices such as Post Offices, municipal clerk’s offices, libraries, etc.

  • Your license plate number. Once you enter your plate number, you will have an opportunity to view non-eligible license plates.
  • Credit Card or checking account.
  • A valid email address.
  • Current insurance.
Please make sure that you go to the official site: www.colorado.gov\renewplates.    Beware that there are “scalper” sites that charge an additional fee to use their web site.  Keep in mind that should you accidentally use one of those sites; neither the state nor county can refund your money.
Basically, the transaction needs to be a “perfect” renewal.  You can’t change your address and your insurance must be current in the system. 
The great news is, this is a 24/7 service!

eRecording is Available!

The main focus of recording is the maintenance and integrity of the Saguache County Public Land Records which date back to the 1800’s.  Our duties include recording and imaging documents for permanent public record; providing a grantor/grantee index for search and retrieval of recorded documents and providing copies of those documents to the public upon request.
Documents typically recorded in our office include but are not limited to:
  • Deeds (warranty, quit claim, beneficiary, personal representative, etc.)
  • Deeds of Trust and Mortgages
  • Plats and Land Surveys
  • Easements and Covenants
  • Liens and Transcripts of Judgment
  • Marriage and Civil Union Licenses
  • Military Discharge Records
The Saguache County Clerk & Recorder’s Office offers eRecording services.  Electronically submitting documents for recording increases speed and security and decreases costs, when compared to traditional mail submissions.

The Saguache County Clerk & Recorder's Office for Motor Vehicle and Recording departments only, will be CLOSED for the Primary Election on June  26, 2018 and also for the General Election on November 6, 2018. The Voter Service & Polling Center (VSPC)will be open from 7:00 a.m. - 7:00 p.m.  Sorry for any inconvenience.
